This is where my contract law class from college fails me. Is agreement to consider you for a job actually considered "consideration". If it is not ... then the sculpt isn't really GW's property. Its one of those wierd legal grey areas.
I'm sure the sculptor is happy to submit an example of his work as a test piece for GW to consider ... but when they keep the test piece ... if they don't pay for it ... is it legally their property?
I honestly don't know the answer and that's why I'm not sure what the "correct" answer is to this.

Believing the same thing as you I asked the seller through Ebay question if he had more than one to sell since I'd like to see more than Galak and/or Traveller own this figure.
The response I got was:
"I have my own production mould for this figure. I do plan to do another auction for it in the future but not sure how often. Definitely not more than once a month and with my work schedule I could easily see some months where I do not get an auction posted. I do not want to deceive anyone with this auction as I am not selling the original metal master that I was able to purchase. The person I bought it from told me that the rights for production casting this figure were in question and I should be okay to try this auction. Guess I will find out. For the real collectors I filed down the base tab to be blank so that it will be easy to tell for anyone if one of these miniatures is an original metal master or one of the figures in the auction."
Yeah ... I do know that is there Ith ... but in US law I don't think you can legally hold someone to that. You HAVE to give consideration for something to become your property. I honestly think that that line by GW is a fake out. I know I was given something for all the articles I submitted to them that were actually printed and profited from.
I'm not sure about UK law ... but my understanding of US law is that that sentence by GW is full of holes and cannot hold water.

Oh it's a very dodgy catch all statement that's for sure, but knowing GW lawyers it'll be pretty water tight and I have no idea if it would come under UK law being a UK company and thus UK property or what... Either way, I hope the figures keep coming out, it looks a lovely model which I'd like and I really don't want GW to notice this

Well... I had that mini on the picture on my hands. Indeed I think I was the one posting the picture, because the painter gave sent it to me. The actual mini is transformed (mutilated) because it's owner did not know what he had in his hands and asked the painter to replaced it for a claw (almost killed him).
As my friend told me (the owner of this piece) it seems that it was a limited edition gived to representative members of the GW firm. As my friend was related to one of them, he got it as a present. The miniature is still in its collection.
Indeed, I don't know why he is using that picture if it clearly does not belong to him and has not asked for any authorization...
